The rules that apply
Under California Code of Civil Procedure § 335.1, you generally have two years from the date of your accident to file a personal injury lawsuit. Surveillance video, traffic-camera footage and witness memories disappear much sooner, so call early.
California is a pure comparative negligence state (Li v. Yellow Cab Co.). If you were partly at fault, you can still recover compensation, reduced by your share of fault. Insurers often try to inflate that share, and we push back.
If a Metro bus, a city or county vehicle, or a dangerous public road caused your accident, you may have only six months to file a government claim under Government Code § 911.2. That is much shorter than the standard deadline, so talk to a lawyer right away.
